A casino patron who was unfortunate enough to be struck in the face with a bouncing roulette wheel ball has lost his lawsuit which he sought $300.000 for his injuries.
Lender Stocks, a resident of Maryland attempted to sue the Arundel Mills Casino, for alleged ‘traumatic’ injuries he received from the bouncing roulette ball which was described as a ‘high-velocity misguided missile’. Stocks also claimed that the treatment he received after the incident led to him being injured further.
Stocks claimed that Croupier, Mildred Morse had been negligent and was to blame for the incident. The defence denied any wrong-doing and claimed that these incidents can occasionally happen with any negligence or lack of care.
During its brief flight, the errant, airborne and unguided roulette wheel ball became a missile that opportunistically struck the Plaintiff just above the left eye at extremely high velocity, thus ending its hopeless attempt to defeat gravity.
Stocks had claimed that he had suffered traumatic eye injury and a severe contusion after being struck by the ball. Stocks also alleged that first-aid was administered ‘without warning or consent’. A casino employee had administered eye drops which caused him to have blurred vision, pain and a loss of disorientation. Stocks claimed, he attempted to leave the room but fell and violently hit his head on a metal door which caused him to lose consciousness.
Lawyers for the defence argued that the injury to Stocks was ‘minor and transient’ and that he had requested eye drops and fell because he had dragged his leg and did not hit his head on the door.
It took less than an hour for the jury to throw out the case, where the judge deemed Stocks lawsuit ‘opportunistic’. Stocks lawyer had attempted to withdraw from the case pre-trial.
